Is it legal for the state to ask for half of the ashes of a previously executed death row inmate?

I have a cousin who was recently executed in the state of Texas and my Aunt was going to have him cremated but unless she agrees to give the state half the ashes they will not let her cremate him. Please I need legal advice thanks!
